I’m Mark Gansert, a disabled Texan with Factor V Leiden (FVL), fighting University Health (UH) in San Antonio—a state actor—for my life. They’ve botched my care, banned me from doctors, and left me with an untreated clot. This isn’t just negligence; it’s federal law violations. Congress, I need you to act—contact HHS OCR and UH’s Joshua H. Nieto now.
The Breakdown: What UH Did
- CT Misdiagnosis: Dec. 31, 2024—UH’s radiologist missed a mesenteric clot on my CT. (My hemo/oncologist, Dr. David Heile, said "how'd they miss that with liver enlargement?). Bowel necrosis hit; same exact CT scan now showed necrotic bowel and enlarged liver. Surgery saved me (even with emergency surgery, mortality rates are 85–100% for that level of bowel necrosis). Jan. 4, 2025.
- Retaliation: Filed a Texas Medical Board (TMB) complaint—UH’s Dr. Hamilton-Bevil retaliated after I reported her failure to treat my conditions. She banned me from UMA doctors via CareLink. I still have CareLink, but no UH docs? No due process for being banned from a county-run hospital with tons of federal money.
- Ultrasound Failure: March 13, 2025—Dr. Hunter Lau ordered only an upper-leg ultrasound despite FVL/DVT risk. ACEP Guidelines (2016) say it should’ve been full-leg. UT Health hematologist ordered it again. UH delayed it, made me go outside their normal system to schedule. Why? Still untreated, still in pain. Nieto has been notified directly and ghosted me. Huge civil rights violation.
Federal Laws Broken
- Section 1557 (ACA, 42 U.S.C. § 18116): UH discriminates—FVL means I need real scans, not delays or bans. Equal care’s gone.
- ADA Title II (42 U.S.C. § 12132): Public entity, UH denies me access—CT miss, UMA ban, half-assed ultrasound.
- Section 504 (Rehab Act, 29 U.S.C. § 794): Federal funds? Yep. Same discrimination, plus retaliation for fighting back.
- § 1983 (42 U.S.C. § 1983): Deliberate indifference—UH and Lau know FVL’s risks, let me clot anyway. Due process trashed.
The Damage—Real and Raw
- Physical: Leg pain and swelling from an untreated DVT since March 13, 2025. Due to UMA doctors ban I have been unable to have treatment for the following conditions: Bi-lateral inguinal hernia, a partially ruptured calf, my ADHD medicine, and within UH system I’ve been banned from the 24-hour pharmacy for complaining about partial fills of my life-saving "rat poison" anticoagulant. No appeals, no oversight—just bans.
- Emotional: Constant dread—will the next clot kill me? They’ve failed twice. Would *you* give them a third shot?
- Financial: SSA policy says 3 clots in 1 year = disability. So I have to nearly die 3 times to qualify? It takes long cardio workouts and daily injections of pig-gut-derived anticoagulant to survive. The Jan. 4, 2025 necrosis wiped me out—9 months just to physically recover.
Proof’s Out There

Your Move, Congress
Senators, Congresspersons—I’m begging you. UH’s a state actor in clear violation of Federal statutes.

One call, one email, and you save my life. Act now—my clot’s growing. My contact information is in the OCR filing. Please help me.
Stacy Foremski—she’s UH's 1557 Coordinator, lying about sending me emails.
Empty promises about reviewing practices, policies, nothing will change with this woman. UH will not comply without Federal Government oversight. FACT
UH's General Counsel's response time—nothing for over a week! UH Patient Relations is now into weeks of silence. I called them and was routed to Ms. Foremski. Who during a recorded call lied about sending me emails yesterday. So technically, still no contact from them.
This type of silent treatment is retaliation, and in this case, life-threatening.
Here is your real-time proof of UH trying to kill me
On 3-13-25 at UH I had no DVT... as of today 4-4-25 I do. How many more people have been getting misdiagnosed? 4-4-25 UH 1557 coordinator Stacy Foremski tells me on the phone that she emailed me at 3:15 PM yesterday. Guess what no email in my actual inbox.
University Hospital finally bothers to respond
